This Legal Notice sets out the identifying details of ACERTARE and TRASCIENDO, parent and subsidiary respectively. In the other legal documents on this site — such as the Privacy Policy or the Cookie Policy — references to “ACERTARE” mean both companies together, since they process data for the same purposes and the same policy therefore applies to both.

2. Purpose and scope

This Legal Notice governs access to, navigation of and use of the website acertare.com and all of its subdomains and sections (the “Website”). Access to the Website is free of charge and confers the status of user on anyone who accesses it, which implies full and unreserved acceptance of every provision of this Legal Notice from the moment of access.

ACERTARE provides consultancy in ethical change management, together with training, certification and support for organisations undergoing transformation. The Website is informational and commercial in nature.

3. Conditions of use

Users undertake to use the Website diligently, correctly and lawfully and, in particular, to refrain from:

ACERTARE reserves the right to deny or withdraw access to the Website at any time and without prior notice to users who breach these conditions.

4. Intellectual and industrial property

All content on the Website — including but not limited to text, photographs, graphics, images, icons, technology, software, links, audiovisual content, graphic design and source code — belongs to ACERTARE or to third parties who have authorised its use. No exploitation rights recognised under applicable intellectual property law are assigned to the user.

The trade marks, trade names and distinctive signs appearing on the Website — including Acertare®, DOIT Change® and TARI — belong to ACERTARE or to their legitimate owners. Nothing on the Website may be construed as granting any licence or right to use those signs.

The methodologies, models and frameworks published on the Website are made available for informational and educational purposes. Their commercial use, their reproduction in third-party training materials or their incorporation into consultancy services requires ACERTARE’s prior written authorisation.

5. Use of artificial intelligence

ACERTARE uses artificial intelligence (AI) tools in some of its processes. In the interest of the transparency required by Regulation (EU) 2024/1689 on Artificial Intelligence, we disclose the following:

5.1. Website content

Some of the content published on the Website — including text, summaries, translations and supporting materials — may have been generated, assisted or reviewed using artificial intelligence tools. All published content is subject to human oversight before publication. Nevertheless, ACERTARE does not warrant that such content is free from errors, omissions or inaccuracies.

5.2. TARI, our conversational assistant

In accordance with Article 4 of Directive (EU) 2019/790, ACERTARE expressly reserves its text and data mining rights over the content of the Website. Its use for training, fine-tuning or evaluating artificial intelligence models without prior written authorisation is prohibited.

The Website may contain links to third-party pages. ACERTARE exercises no control over those sites and accepts no responsibility for their content, privacy policies or practices. The inclusion of a link does not imply approval, sponsorship or recommendation of the linked site. We recommend reviewing the legal terms and privacy policies of any third-party site you visit.

7. Disclaimer of warranties and liability

ACERTARE makes its best efforts to ensure that the information on the Website is accurate and up to date. However, it does not warrant:

9. Governing law and jurisdiction

This Legal Notice is governed by Spanish and Mexican law, as applicable depending on the group company with which the relationship is established and on the user’s place of residence.

For the resolution of any dispute arising from access to or use of the Website, the parties submit to the courts of Madrid (Spain) or Mexico City (Mexico), as applicable, unless consumer protection legislation establishes a different mandatory jurisdiction, in which case the latter shall prevail.
