This Privacy Policy sets out how ACERTARE, S.A. de C.V. and TRASCIENDO, S.L. (together, “ACERTARE”, “we”, “us”) collect, use and protect the information you provide when you use this website and our services.

ACERTARE is committed to safeguarding your data and your privacy. Any information you give us will be processed only in accordance with this policy. If you have any question about this Privacy Policy or about our practices regarding your personal information, write to us at contactos@acertare.com.

1. Who is the data controller?

Both companies process data for the same purposes and under the same safeguards, and therefore act as joint controllers. You may exercise your rights against either of them through the email address above.

2. What data do we process?

We process the personal data you provide when you interact with us, together with data generated as you browse. Specifically:

2.1. Data you provide directly

• Identification and contact data: name and surname, email address, telephone number, company or organisation, job title, country of residence and language.
• Enquiry data: the content of your message, the service you are interested in, the transformation stage your organisation is at, and any information you choose to include in our forms.
• Application data: if you apply for a vacancy or send a speculative application, we process your CV and the professional information you provide (education, experience, expectations).
• Registration data for sessions, training and certification: what we need to manage your participation, issue certificates and, where applicable, invoice you.

2.2. Data generated by your use of the Website

• Browsing data: IP address, device and browser type, language, pages visited, and date and time of access.
• Interaction data: information about how you use our services and which content interests you.
• Data derived from cookies and similar technologies, as described in our Cookie Policy.
• Conversations with TARI: if you use our artificial-intelligence assistant, we process the content of the conversation as described in section 7.

We do not collect special categories of data (health, ethnic origin, beliefs, trade union membership, biometric data or sexual orientation). Please do not include this kind of information in our forms or in your conversations with TARI.

We do not sell your personal data. We share it only with suppliers who provide services to us and act as processors under contract, and with the competent authorities where there is a legal obligation.

6. International data transfers

ACERTARE operates from Mexico and Spain and provides services in several countries. Some of our suppliers are established outside the European Economic Area, in particular in the United States, and the group processes data between Mexico and the European Union.

In these cases we ensure that the transfer relies on one of the mechanisms set out in Chapter V of the GDPR:

• European Commission adequacy decisions, where applicable.
• Standard Contractual Clauses approved by the European Commission, supplemented by any additional technical and organisational measures required.
• The supplier’s certification under the EU–US Data Privacy Framework, where applicable.

7. Artificial intelligence and automated decisions

ACERTARE uses artificial intelligence tools in some internal processes and in the TARI assistant. We want to be transparent about this:

• When you interact with TARI, the content of your conversation may be processed by language-model providers acting as processors, for the purpose of generating a response.
• We do not use your conversations or your personal data to train third-party artificial intelligence models.
• Please do not enter third-party personal data, confidential information or special categories of data into your conversations with TARI.
• We do not take decisions based solely on automated processing that produce legal effects concerning you or similarly significantly affect you. Job applications and service proposals are always assessed by people.
• Some of the content published on the Website may have been generated or assisted using AI and reviewed by our team before publication.

8. What are your rights?

As the owner of your personal data, the law grants you the following rights, which you may exercise free of charge:

If you are in Mexico, the Federal Law on Protection of Personal Data Held by Private Parties additionally grants you ARCO rights (Access, Rectification, Cancellation and Opposition), as well as the right to revoke your consent and to limit the use or disclosure of your data.

How to exercise them

Write to us at contactos@acertare.com stating the right you wish to exercise, your name and surname, and an address or means for notifications. We may ask you to prove your identity. We will respond within the periods established by law.

Complaints to the supervisory authority

If you believe we have not handled your request properly, you may lodge a complaint with:

• Spain: the Spanish Data Protection Agency (AEPD), www.aepd.es.
• Mexico: the competent data protection authority under the legislation in force.

9. Minors

The Website and our services are aimed at professionals and organisations and are not directed at minors. We do not knowingly collect data from children under 14 (Spain) or from minors under Mexican law. If we discover that we have received data from a minor without the corresponding authorisation, we will delete it.

10. Information security

We are committed to keeping your information secure. We have implemented appropriate technical and organisational measures to prevent unauthorised access, loss, alteration or improper disclosure of data, including encryption of communications via HTTPS, access controls, protection of forms against automated submissions, and periodic review of our systems.

No system is entirely infallible. Should a security breach occur that poses a high risk to your rights and freedoms, we will notify you and report it to the supervisory authority as required by law.

11. Changes to this Privacy Policy

ACERTARE reserves the right to amend this policy to reflect legislative or case-law developments and industry practice. In such cases, it will announce the changes on this page a reasonable time before they take effect.

In accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons (GDPR), and with Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), we remind you that your data is processed by ACERTARE, S.A. de C.V. and TRASCIENDO, S.L. as data controllers.
