This Privacy Policy sets out how ACERTARE, S.A. de C.V. and TRASCIENDO, S.L. (together, “ACERTARE”, “we”, “us”) collect, use and protect the information you provide when you use this website and our services.

Both companies process data for the same purposes and under the same safeguards, and therefore act as joint controllers. You may exercise your rights against either of them through the email address above.

We process the personal data you provide when you interact with us, together with data generated as you browse. Specifically:

4. How long do we keep your data?

We keep your personal information only for as long as necessary for the purposes described, unless a longer period is required or permitted by law:

We do not sell your personal data. We share it only with suppliers who provide services to us and act as processors under contract, and with the competent authorities where there is a legal obligation.

ACERTARE operates from Mexico and Spain and provides services in several countries. Some of our suppliers are established outside the European Economic Area, in particular in the United States, and the group processes data between Mexico and the European Union.

As the owner of your personal data, the law grants you the following rights, which you may exercise free of charge:

Access Find out whether we are processing personal data about you and, if so, which data.
Rectification Correct errors and amend data that is inaccurate or incomplete.
Erasure Request the deletion of your data, meaning we will stop processing it unless a legal retention obligation applies or other legitimate grounds prevail.
Objection Ask us to stop processing data for which we rely on legitimate interest, setting out the grounds for your objection.
Restriction Ask us to restrict processing where you contest the accuracy of the data, where processing is unlawful but you oppose erasure, where we no longer need the data but you need it for legal claims, or while a prior objection is being verified.
Portability Receive your data in a structured, commonly used, machine-readable format and transmit it to another controller.
Withdraw consent Withdraw consent at any time, without affecting the lawfulness of processing carried out beforehand.

If you are in Mexico, the Federal Law on Protection of Personal Data Held by Private Parties additionally grants you ARCO rights (Access, Rectification, Cancellation and Opposition), as well as the right to revoke your consent and to limit the use or disclosure of your data.

The Website and our services are aimed at professionals and organisations and are not directed at minors. We do not knowingly collect data from children under 14 (Spain) or from minors under Mexican law. If we discover that we have received data from a minor without the corresponding authorisation, we will delete it.

We are committed to keeping your information secure. We have implemented appropriate technical and organisational measures to prevent unauthorised access, loss, alteration or improper disclosure of data, including encryption of communications via HTTPS, access controls, protection of forms against automated submissions, and periodic review of our systems.

No system is entirely infallible. Should a security breach occur that poses a high risk to your rights and freedoms, we will notify you and report it to the supervisory authority as required by law.

11. Changes to this Privacy Policy

ACERTARE reserves the right to amend this policy to reflect legislative or case-law developments and industry practice. In such cases, it will announce the changes on this page a reasonable time before they take effect.
